Hannover school board must decide whether trans athletes can play girls' tennis
The Hanover County School Board will vote next week on whether to allow a transgender student to play on the girls' tennis team.
The decision comes the night before a federal judge is set to hear a lawsuit accusing school administrators of breaking the law by previously denying the 11-year-old a spot on the team.
Janie Doe auditioned for the Hanover high school girls’ tennis team in 2023 and was selected. But the school board concluded that Janie had a pseudonym used to protect her identity and that she would not be allowed to play on the team that fall because she was assigned male at birth. The school district’s policy states that for all sex-segregated activities, student participation must be determined by sex, not gender identity. However, the policy does provide for reasonable accommodations on an individual basis.
At the August 13 meeting, the Hanover School Board will discuss a new request for Janie's participation.
Judge M. Hannah Lauck of the U.S. District Court for the Eastern District of Virginia has postponed a hearing pending the school board's decision on the ACLU of Virginia's request to prevent Hanover schools from again banning Janie from the girls' team.
Hanover's attorneys argued in court documents that the request is premature because it was filed in anticipation of Hanover's denial of Janie's request.
The ACLU filed the lawsuit on July 3 against the school board, former Superintendent Michael Gill, who resigned in July, and school board Chairman Bob May. The ACLU alleges that Hanover violated Title IX, which prohibits discrimination on the basis of sex in any school or educational program that receives federal funding.
Virginia Attorney General Jason Miyares filed a brief in court last month in support of the Hanover schools. He argues that the policy, modeled on the Virginia Department of Education’s policy for trans students, does not violate Title IX. He says the state has an interest in maintaining competitive fairness in sports.
The ACLU has filed two other lawsuits in state court challenging the state’s policy. One, in York County, was dismissed. The second, in Hanover, is scheduled for trial Aug. 20.
