Sharing Google location PIN in exchange for bail violates privacy: Supreme Court

The Supreme Court ruled on July 8 that requiring defendants to share their Google location PINs with investigators to make it easier to track their movements violates their right to privacy.

Justice AS Oka and Justice Ujjal Bhuyan said the bail conditions should not defeat the very purpose of granting bail.

There can be no bail condition which defeats the purpose of bail. We have said that Google PIN cannot be a condition. The Supreme Court while delivering the verdict pointed out that the police cannot pry into the private life of a bail accused.

The ruling came in an appeal filed by Frank Vitus, a Nigerian national and a defendant in a drugs case, challenging a 2022 Delhi High Court order that had directed him to share his location with investigators through Google Maps location services as a condition of his bail.

The Supreme Court had earlier asked Google to help it understand the technology better and test its limits in terms of fundamental rights.

In October 2023, Justice Okas was dealing with a similar issue of law in another case involving alleged money laundering, in which the Delhi High Court again granted bail to auditor Raman Braria.

One of the bail conditions is that Braglia must provide the relevant investigator with a Google pin location from his mobile phone, which must remain valid throughout his bail.

He had been arrested in connection with a money laundering probe arising out of the Rs 3,269 crore alleged financial irregularities case against Shakti Bhog Foods Limited.
