(WSVN) – There was a dispute between the tenant and the landlord, and then the landlord’s parking lot was destroyed. Who did it and what is happening now? That’s why the tenant called Howard helped me with Patrick Fraser.

Roberto Salas, owner of United Auto Center: “I was like, What? What’s going on here? I mean, this is like an earthquake or something.”

Who does this in a landlord-tenant dispute? Take a guess, and when we get back to it, you might be surprised.

Roberto Salas: “Yes, we are a very good place. We are very close to Hard Rock Café Seminole.”

Roberto is one of the owners of United Auto Center in Davie, where the parking lot used to look good, and where Roberto rents three bays to sell nice used cars and trucks.

Roberto Salas: “We pay the rent on time, and we’ve never been late in six years.”

But they have an owner in Pelican Bays who often fines the agent. One was $350 for two lube points outside of their warehouse.

The owner also fined them for changing a tire in the parking lot and hit them with a $350 fine for leaving a truck in the parking lot, then towing it after it closed for the day.

Roberto Salas: “The owner, you know, started giving us headaches and doing a lot of bad things to us.”

When the 16th, $300 fine was issued for a leaking toilet that Roberto said cost $10 to fix, Roberto said it was enough.

Roberto Salas: “We pay them fines, $5,000 or $6,000, and I say, ‘No, this time I won’t pay. That’s it.'”

The owner sued to fire United Auto Center for not paying the fine. they opposed.

Next, the front end loader appeared.

Roberto Salas: “So, you know, he does a lot of things to hurt me.”

Pushing the asphalt in front of the car dealer’s door entry, Roberto said he told the operator to stop. The driver apologized but said the owner hired him to do it.

Roberto Salas: “The owner told him to leave the materials like this.”

An employee filmed a video of the guy they call the owner, the guy in the baseball cap.

Pelican Bays is a large depot, but the only stand that was destroyed was the area in front of the United Auto Center.

Roberto Salas: “I don’t do anything wrong. I just sell my cars. I don’t know; it’s just a crazy thing.”

Well, Howard, Roberto thinks this is crazy, but is it legal for a landlord to fine a tenant and, when they don’t pay, destroy their parking lot?

Howard Finkelstein, legal expert with 7News: “In this case, no and no. The lease does not allow for fines, and if the tenant does not pay one, it does not give the landlord the right to rescind the lease and evict him. In this case, you also cannot destroy the parking lot. Your own. The law calls this a constructive eviction, meaning the landlord did not give notice and meddled with the tenant’s business.”

I called the owner of Pelican Bays, Charles Rowars, to find out why he had destroyed his parking lot. He didn’t answer my calls.

I went to Roans’ office. The door was locked. Someone was inside but didn’t come out.

I called Roars’ lawyer. He didn’t reply either, but they’ll have to speak up when they face a judge.

Howard Finkelstein: “A judge can act quickly on this case. In my opinion, the owner has a lost case, and the court can sentence the auto dealer to damages for lost revenue and the cost of moving to a new location if they want to move out.”

Roberto Salas: “We called the police. We called law enforcement.”

Call the police because their cameras caught someone trying to cut the door locks. Law enforcement was called again because 20 truckloads of sand were dumped around the dealership. Their customers cannot login now.

Roberto Salas: “There is no way we can do things like this. This is crazy, I don’t know how to describe it.”

Davy has now issued an infringement notice against the owner for ripping into a parking lot without a permit. Problems pile up for the owner, but they also pile up for United Auto Center. We will tell you what the judge decides to do in this strange and strange case.
