Reversing Roe v. Wade is a major legal move

(WHTM) — After the Supreme Court overturned Roe in Wade, contrary to decades of precedent, emotions flow on both sides of the case.

Planned Parenthood and the Young Women’s Christian Association helped organize demonstrations in the center of the state, with hundreds of people expressing shock and anger at the court’s ending of the constitutional right to abortion.

“It is horrific to imagine that we are turning back the clock,” said Stacy Blake, CEO of YWCA Lancaster.

Others celebrate the ruling.

“Roe v. Wade is bad policy and it’s right to reverse it,” said Maria Gallagher, legislative director of the Pennsylvania Pro-Life Federation.

No matter which side of the issue people are dealing with, resolution is a major step.

“You could aptly describe this as a judicial earthquake,” said John E. Jones III, a former federal judge and president of Dickinson College.

It’s extremely rare for the Supreme Court to overturn an earlier ruling, John said.

“Blowing up an actual precedent the way the case did today is something that some people just don’t see in their lives,” he said.

Jones said the majority view contested the constitutional right to abortion.

“justice [Samuel] Essentially Alito writes that Roe’s decision was made wrong from the start.”

Jones said the court recognizes that people have rights not expressly set forth in the Constitution, but the justices have argued that termination of pregnancy is not among those rights.

“That’s a long way off,” Jones said.

Justice Clarence Thomas went further, writing in his supporting opinion that the court should also reconsider cases of legalizing same-sex marriage and expanding access to birth control.

Jones said of Thomas’ legal philosophy: “If it’s not in the text of the Constitution…you don’t have that right.”

Jones does not believe Thomas’ opinion will be accepted by other judges, but the reversal of Roe v. Wads still raises some concerns.

“All the court has is its credibility,” Jones said.

He worries that the public may lose faith in the court and see it as merely a partisan institution. Jones said the leaking of Judge Alito’s draft opinion in May actually damaged the court’s standing.

“This is hard for the public to understand,” he said. “Courts are not supposed to be constrained by political ideals or specific campaigns.”
