IHC rejects petition calling for removal of dual nationality SAPMs – Pakistan

ISLAMABAD (Dunya News) – Islamabad’s High Court on Thursday rejected a petition calling for the removal of special assistants to the Prime Minister (SAPM) with dual nationality.

IHC Chief Justice (CJ) Judge Athar Minallah read the verdict.

In its verdict, the court said the prime minister’s special assistant could not be disqualified for having dual nationality.

The verdict said that a person with dual citizenship is also a Pakistani and his patriotism cannot be questioned.

The verdict further stated that the appointment of a special assistant is the prerogative of the prime minister, in this case there is no restriction on the number of special assistants.

“The Prime Minister is accountable to the people and he cannot rule the state system alone,” said the verdict.

Earlier today, IHC had reserved its verdict on whether a case challenging the appointment of special assistants to the prime minister was fit to stand trial. Chief Justice Athar Minallah reserved the verdict on Thursday. “Where is it written in the Constitution that assistants cannot hold dual nationality?” He asked.

On Tuesday, a petition was filed with the High Court in Islamabad (IHC) to challenge the appointment of special assistants to the prime minister with dual nationality. The petitioner, Justice Party chairman Malik Munsif Awan, pleaded for the appointment of four SAPMs, who had dual nationality, to be declared null and void, as a person who owed allegiance to another country should not be declared null and void. not hold key government positions and make decisions about the country. .

He argued that the tribunal should issue instructions for the removal of the four SAPMs from their posts in the national interest because they had access to sensitive information about the country, including its nuclear assets.

The petitioner also asked the court to prevent the four SAPMS from working until it has ruled on the case.

Mirza, who was given the national health services portfolio in April 2019 and oversaw the country’s response to the pandemic, said he made the decision to step down after “a negative discussion about the role of SAPMs and criticism of the government “.

Meanwhile, Aidrus said she was resigning her post due to recent criticism of her and the government over her dual nationality.

In a tweet, she said: “Criticism directed at the state because of my status as a citizen obscures the goal of digital Pakistan.

“In the greatest public interest, I have tendered my resignation from the post of SAPM. I will continue to serve my country and the PM’s vision at best.”

She said her Canadian nationality, a consequence of her birth and not an acquisition of choice, distracted attention from her ability to implement the long-term vision of a digital Pakistan.

“It is unfortunate that a Pakistani’s desire to serve Pakistan is clouded by such questions,” she said in Dawn’s report.
