New law to help tenants “protect their homes from earthquakes” – EQC

The Earthquake Commission (EQC) has praised the recent amendment to the New Zealand Housing Act as it will help tenants make their homes safer in the event of an earthquake.

Among the changes stipulated in the Residential Tenancies Amendment Law, property owners are prohibited from unreasonably withholding approval for a simple installation, renovation, change or addition to a leased property. The change will take effect on February 11, 2021.

According to Dr. Joe Horrocks, Head of Resilience and Research at EQC, this means that tenants will be able to take measures to secure their furniture and appliances against earthquake risks.

“We know from our research that many landlords are really happy to allow tenants to secure things like bookcases on the walls to make their homes safer,” she said. “However, these changes will help tenants who may have difficulty getting approval for the kind of work that needs to be done.”

The law also requires tenants to return the building to the same condition it was in before the changes were made.

The EQC urged tenants to properly secure tall and heavy appliances and furniture, given the increased risk of damage and injury during an earthquake. These include bookcases, drawer sets, cabinets and hot water cylinders.

Horrocks added that owners should also take steps toward strengthening their property, such as removing or replacing hazardous chimneys and making sure foundations are in good condition and properly secured.

“The last thing many landlords want is an uninhabitable property due to damage from a disaster,” she said.
