Governor Lamont’s emergency powers were challenged in court

 


A lawsuit was filed on Monday on behalf of two restaurant owners, a skincare company, and a woman who was fined for violating the quarantine after traveling, and Rep. Mike France, R-Lidyard, asks the court to declare the governor’s emergency powers void.

Governor Ned Lamont’s emergency powers were extended until February after legislative leaders and members of the Public Health Committee voted. Republicans voted against extending the governor’s powers, but were rejected by Democrats, who received the majority of votes.

Prosecutors represent Rep. Craig Fishbein, R Wallingford, and Representative Doug Dubitsky, R Chaplin, who have brought other lawsuits against the governor’s executive orders.

The complaint contains two cases: the first asserts that the COVID-19 pandemic does not fall under the category of civil preparedness emergency as defined by state law, and second that Connecticut’s low hospitalization rate means the governor’s extension of the public health emergency declaration is invalid.

This is the fifth suit of its kind that is filed to challenge the governor’s emergency declaration or his executive orders.
