A Look at Amy Connie Barrett, Supreme Court Nomination SweeperExBulletin

We expect President Trump to announce Amy Connie Barrett as his nominee for the US Supreme Court this afternoon. Judge Barrett sits in the Seventh Circuit of the Court of Appeals in Chicago, despite being in Indiana, and has served as clerk for Judge Antonin Scalia. She will, of course, fill the vacancy left by Ruth Bader Ginsburg, whose life and career was honored in court in the capital this week and who will be buried next week at Arlington National Cemetery.
Let’s now welcome Michael McConnell, a professor of law at Stanford University and a former federal appeals court judge. Thank you very much for being with us, sir.
Michael McConnell: It’s a pleasure.
Simon: I know you know Amy Connie Barrett. How do you rate her apparent candidacy, what kind of justice would she be?
McConnell: Well, I am. She was a professor at Notre Dame Law School for nearly 15 years. In that capacity, I knew her well. She – we’re not personal friends, but I admire both her academic work and her performance in the Southern Circle. I think it’s a totally unsurprising candidate. Even her opponents realize that she is very qualified, very smart and hardworking.
What her personal friends know is how warm, kind and considerate a human being is fantastically. And she – I think she will be an inspiration, especially for working mothers, like my two daughters, because she has seven children, including two adopted children from Haiti, one of them in the aftermath of the terrible earthquake.
And almost everyone who knows Amy has a story about how she is so cute and thinks about things in ways that no one knows – not publicly – but only – and as a cool, warm human being.
Simon: Let me ask about a few general matters, because you are a former judge in an American appeals court. I wonder if you’ve noticed any particular judgments she had the opportunity to make in her time on the bench.
McConnell: Well, in not three years as an appeals judge, I wrote a hundred opinions, and that in itself is impressive. This is – and they are – and I haven’t read them all, but I have read quite a few of them, and they’re always kind of restrictive and attorney. She was a writer for Judge Scalia, who was a great writer. She doesn’t write like Scalia. As you know, for better or for worse, her opinions are not very rhetorical. They are strict. They are much less than that. And you know, just them – they’re consistently conservative, but generally conservative. I don’t think – there is no extreme bone in her body.
Simon: Does she have opinions that might surprise some of her supporters every now and then?
McConnell: Every now and then – of course, nobody really knows where any judge is going to come …
Simon: Okay …
McConnell: … in every case.
Simon: And maybe we should remind ourselves that describing someone as a conservative jurist does not mean that they will always vote a certain way, right?
McConnell: That’s right. And the modern conservative legal movement is a little different from conservative politics because the conservative legal movement mostly revolves around a more restrictive role for judges – they should read the constitution humbly, humbly, you know, and not read their preferences. Inside. This generally means leaving the legislatures and Congress to make the most democratic options rather than making the court like the superior legislature.
