A cultural earthquake demonstrates the need for social justice reform
Although the global pandemic will mark the anniversary of 2020 for many, last year’s cultural earthquake also called for priority attention to the long-awaited needs of social justice reform.
Earthquakes often come without warning, affecting the surface for a relatively short time. But it is actually the culmination of long periods of turbulence deep beneath the surface. When fault lines erupt in society, the longstanding friction points that led to the earthquake include a history of inequality and disparities in education, housing, health care, and access to capital, exacerbated by facts such as environmental injustice.
Regardless of the event causing the fracture, there is usually one common element in the epicenter: law enforcement.
The conflicts that erupted last summer over racial equity and justice were the result of more than 400 years of accumulated fears. On one side of this rift were disadvantaged communities, most of whom were black; On the flip side, too often, was law enforcement.
While the underlying causes are not all related to law enforcement, conflict often results from the interaction between law enforcement authorities and societies that have historically been oppressed, through reality and perception. This is especially true when the reaction involves the use of force.
As 2021 progresses, those of us in the legal system must work hard to reform programs, policies, and procedures that can be measurably improved to enhance the perception and reality of equal justice under the law.
Our country is divided over how federal, state, and local law enforcement works to protect our communities. There are advocates who are enthusiastic about a heavy police presence to enforce “law and order”. With equal emphasis, others argue that some neighborhoods are subject to excessive surveillance and that resources must be reduced or redistributed.
Resolving this conflict over society’s expectations for law enforcement is at the core of social justice work in the future.
Complaints and allegations of excessive force by the police often center around whether the officers acted in accordance with appropriate law enforcement standards. The increased police use of body-worn cameras can effectively help prove the facts.
I think we should provide public access to these videos as soon as possible after suspicious incidents, while minimizing the risks for official investigations. This transparency and public accountability is essential to building stronger societal confidence in law enforcement.
The volcanic eruptions that peaked last summer are the product of an unfortunate cycle of action and reaction on both sides. Rising crime rates in a disenfranchised society lead to calls for increased police presence, leading to more police arrests – and more confrontations with the potential use of force by law enforcement. Sometimes, too much force is used.
A review of policing standards is essential and it certainly should include a structured, structured and productive community discussion about society’s basic expectations and what they should be in relation to law enforcement.
The role of recidivism in the crime cycle and the need for effective re-entry programs to break this cycle are also integral to the conversation.
In the Northern Florida region, we are primarily reviewing our BLAST program – building lasting relationships between law enforcement and the community – so that its focus includes guidance from the community, not just from law enforcement.
We will significantly involve the black community (and especially youth) in the content, and we will work with our local, state and federal law enforcement partners to engage the North Florida community in this dynamic and ongoing public exchange. This will include a publicly broadcast roundtable discussion on BLAST as part of our celebration of Black History Month in February.
We can make 2021 a historic year for renewed confidence in law enforcement, if we are transparent and accountable to the public, we are sworn to protect and serve. This effort is a priority already underway in our office, and it should be in communities everywhere.
