Lucknow: Following widespread criticism of the “unlawful search and arrest” clause in new legislation UP Special Security Force Act 2020, the UP government clarified on Tuesday that no new provisions have been added to the law creating Special Uttar Pradesh Security Force (UPSSF) and only those powers already given to the Central Industrial Security Force (CISF) have been given to the force.

Issuing a clarification, the additional secretary of the UP (at home), Awanish Awasthi, said under Section 10 of the Act, the force can control any person without an order which (Section 8) is found obstructing the tasks of the forces or by indulging or threatening to indulge in any kind of attack or display of aggressive criminal behavior, without giving him an opportunity to leave or conceal his offense. If the search proves the crime, an arrest can be made without the permission of the judges.

Under the Act, the force will be required to hand over the arrested offender to the police and in the absence of a police officer, prepare a report outlining the conditions leading to the arrest and take the detainee to the nearest police station. The government had announced on Sunday that the newly constituted force being created at a cost of close to Rs 1,750 crore will have a force of 9,919 and will guard courts, administrative offices and tourist sites, metro stations, airports, important institutions industrial and vital installations. A major event that had led to the formation of the law was an exchange of fire in the courtroom in Bijnor last year, where a man shot dead a person accused of killing his fathers.

Although similar forces existing in Maharashtra and Odisha also enjoy the power to search and arrest without order, critics think such a clause would give unimpeded power to the force in a state whose police often face weaknesses, clashes with criminals and corruption. The opposition Samajwadi party had called it a black law aimed at suppressing the constitutional rights of the people by order of the ruling government.

Recently, Mahoba District Police Chief Mani Lal Patidar was suspended for soliciting bribes from a businessman before the latter died from bullet wounds after being shot by men allegedly belonging to the Patidar’s family. . In a video released by the businessman earlier, he had warned that if he were to die, Patidar should be held accountable. Charges of murder and conspiracy have been added against the SP but no arrests have been made yet.
