NEW DELHI: Just less than 200 days after filing a FIR to investigate the conspiracy following the riots that rocked northeastern Delhi in February this year, the Delhi Police Special Cell filed a 17,000-page indictment against 15 people, all protesters anti-CAA, in a city court. This was the culmination of the first phase of the probe.
The indictment has named, among others, United Hate activist Khalid Saifi; Former Congress Adviser Ishrat Jahan; Former VET Advisor Tahir Hussain; Wings of RJD youth Meeran Haider; Pinjda activists Tod Gulfisha Fatima, Safoora Zargar, Natasha Narwal and Devangana Kalita.
Six other defendants Umar Khalid, Sharjeel Imam, Danish, Parvez, Ilyas and Faizal Khan have been arrested in the case but are not mentioned in this indictment. Police will file additional leaflets naming them and other people who may be arrested. The defendants have been charged under a plethora of sections of the IPC Act and the Prevention of Illegal Activities (UAPA).
It took weeks of planning, says the loading sheet
The sections of the Indian Penal Code deal with criminal conspiracy (120B) read with murder, insurgency, promoting enmity between two groups, riots, ambiguity and a few others. The Public Property Damage Prevention Sections Act and the Weapons Act have also been called.
The indictment was presented in the court of additional hearings of Judge Amitabh Rawat in the Karkardooma courts in the capital.

Delhi police have said in the indictment that the main conspirators were in direct contact with the men on the ground when the violence erupted on February 24th. Many Whatsapp groups became dedicated to the 20 places where Anti-Citizenship Act (ACT) protests were taking place. There was a systematic mobilization of the crowd to incite violence in dressing up anti-CAA protests, police told the court.
Police also concluded that the riots and protests were funded by several groups, including the PFI, and took weeks of planning to collect weapons, stones, ammunition and ammunition such as Molotov cocktails on the terraces for use in the riots. thus showing a conspiracy intent.
Delhi Police said that during their investigation, they reviewed and listed 747 witnesses to support their case. Witnesses include insiders who helped police understand how Whatsapp groups were used to coordinate the protests. These insiders are learned to have registered their statements before a judge under Article 164 of the Code of Criminal Procedure (CrPC) which is admissible as evidence. In their statements, witnesses explained how these groups were set up for the sole purpose of violence and riots.
Much of the evidence is in electronic form as data from 75 electronic devices seized by the accused have been analyzed and attached to the indictment sheet. Data extracted from the devices includes text messages and Whatsapp conversations between individuals and groups.
Based on scientific, documentary and evidence, 15 defendants have now been indicted by the 21 people arrested so far. The remaining six persons are expected to appear on the indictment in due course after gathering sufficient evidence and meeting legal and procedural requirements, police said.
The loaded sheet submitted today runs to 11 volumes, totaling over 17,000 pages. The honorable court has been asked to obtain knowledge of the criminal offenses and begin the trial of the accused persons on the indictment, police added.
In a statement issued after the filing of the indictment, Delhi Police said: Claims amounting to more than 20 Cro Rs to compensate for the loss of property have been filed before the GNCTD, which indicates the scale and high cost of the tragedy. The statement said about 16,000 PCR calls were received during the violence and 751 cases were registered by police. Fifty-nine cases were assigned to an SIT constituted in the Crime Branch, 691 cases were investigated by the district police and one case which was registered on March 6, 2020 to investigate the largest plot after these riots was assigned to the Special Cell .
