The Supreme Court should look at regulating digital media ahead of electronic media when it comes to setting standards, as it has far more impact, the government has told the high court.
In a statement on setting standards for electronic media ahead of today’s hearing, the government said the court should first look at digital media because of its impact and impact.
“Digital media has a faster reach, the potential to go viral because of apps like WhatsApp and Facebook,” the Center’s swearing-in statement to the Supreme Court says.
“Digital media has a serious impact and because of its potential, the court must first get digital media,” she says.
The government also says it has “sufficient framework and judgments” on the electronic and print media. “The issue of balancing freedom of speech and responsible journalism has already been governed by legal provisions and judgments,” he says, adding that electronic media is driven by previous cases and precedents.
The government has also asked the high court to appoint Amicus Curiae – a friend of the court – or a panel to assist the court in deciding on the instructions.
The center’s affidavit relates to a case against a private television channel, Sudarshan TV, for a show claiming that “Muslims are infiltrating” government services. In a petition, the show was awaited by the court on the grounds that it tries to insult Muslims. “You can not target a community and mark them in a particular way,” the high court said on Tuesday, banning Sudarshan TV from broadcasting its “UPSC Jihad” episodes on the “Bindas Bol” show.
At Tuesday’s hearing, the Supreme Court expressed concern about the race for TRP and “sensationalism” on TV and had said it would set up a panel to suggest standards for electronic media. Journalistic freedom is not absolute, the judges said, demanding that a panel of five distinguished citizens come up with standards for electronic media.
The court’s sharp observations were related to concerns over the harsh, banned and often challenged ethics of Sushant Singh Rajput’s death investigation by several channels.
When the Press Council of India said the regulations are in force, Justice DY Chandrachud retorted the answer: “Really? If things had been so turbulent, we would not have to watch what we see on TV every day.”
The Broadcasting News Association has said in its affidavit that if any channel violates the code and is found guilty in an investigation, it should be fined up to Rs 1 lakh.
