Madhya Pradesh HC Orders FIRs Against BJP, Congressional Politicians for Breaking COVID-19 Protocol

Bhopal: Confused with violations of the interim Supreme Court order and COVID-19 protocols at political rallies, Gwalior’s high court Madhya Pradesh on Tuesday instructed Gwalior and Datia district magistrates to file an FIR against a Union minister, former Prime Minister Minister of State.

Hearing a liaison request filed by lawyer Ashish Pratap Singh, the two-judge panel of Supreme Court judges including Judges Sanjeev Kumar Shrivastava and Sheel Nagu demanded that the FIR file a lawsuit against Union Minister Narendra Singh Tomar, former Prime Minister Kamal Nath, cabinet minister Pradyuman Singh Tomar, BJP candidate from Gwalior East Munnalal Goel and others for violating COVID-19 security norms.

The court ruled that the leaders violated the COVID-19 security protocol despite its interim order of October 3, where all political leaders were clearly instructed to follow the norms issued by the Union government and the Election Commission of India for public meetings before the by-elections. The Supreme Court has also instructed Gwalior Police Officer and Datia to submit a compliance report in this regard before the next hearing date, 19 October 2020.

The Court said, Given the above situation, in particular the information obtained from the amicus curiae reports and the content of IA 6084/20 submitted by the applicant, the offense under the IPC / Disaster Management Act prima facie appears to have been committed. Therefore, FIRs must be registered by October 14th and its compliance reports must be completed by October 18th. “

On October 3, 2020, the court in its interim injunction ruled against all predetermined members of the congregation and unelected officials of the Govt / state / political parties on whose behalf, the order and for whom and in whose presence the congregations took place violating the Covid-19 protocol.

To date, however, police have registered only one FIR against former Prime Minister Kamal Nath and six other Congressional leaders for violating COVID-19 protocols. during a rally in Bhander, Datia. For the rallies of the leaders of the ruling parties, however, the police have turned a blind eye.

Applicant and lawyer Ashish Pratap Singh along with others had filed a report showing violations of COVID-19 norms by politicians who gathered larger numbers of people at election rallies. The number of people present, they said, exceeded the limit prescribed by the COVID-19 security protocols.

Plaintiff further pointed out that after the court approved an interim injunction on October 3, about 500 people gathered the same day on Baghel Chhatrawas Naka Chandrawani Street, Lashkar in Gwalior. Another rally was organized by former MLA Munnalal Goyal on October 4 in the Gwalior legislative assembly constituency on behalf of Pradyuman Singh Tomar.

Moreover, a similar rally was held on October 4 in the 19th district on behalf of Congress candidate Satish Singh Sikarwar. On October 5, another rally was held at the Mody House opposite the Landmark Hotel on behalf of Union Minister Narendra Singh Tomar.

On the same day in Bhander, Datia district, a meeting was organized by MPCC chief Kamal Nath and Phool Singh Baraiya. On October 6, the COVID-19 protocol was broken again in neighborhood number 1 when an electoral rally was organized for Ramniwas Rawat and Sunil Sharma.

When contacted, State Congress spokeswoman Bhupendra Gupta said the administration in the Gwalior-Chambal region has already filed an FIR against State Congress President Kamal Nath showing a biased stance despite the fact that he has not violated the COVID-19 protocol.
