In the latest attempt to stop the spread of the virus in Scotland, large parts of the country will go into a severe Level 4 blockade by tonight – the closest thing to the March national shutdown seen so far.

People living in a Level 3 or 4 area are now ordered to stay there unless they have any excuse to leave for work, education or welfare reasons.

The regulation states: “Going on holiday, including abroad, is not a reasonable excuse to leave.

“If it has been reported that your local authority area is about to move to level 3 or 4 please do not travel across the sea for non-essential reasons such as vacations.”

People can also leave Level 3 or 4 areas and Scotland for training – if it is within five miles of their local authority.

A long list of exceptions is defined in the regulations as “examples of reasonable justification”.

Nicola Sturgeon said today that the advice for people in Level 4 areas is to stay home for as long as possible for the next three weeks.

She also told the nation that any plan to allow families to mix during the festive period would still carry risks, but she hopes the austerity measures in the coming weeks could push the virus.

She said: “The fact is, the fewer people in the population who have Covid by the time we arrive for Christmas, the lower the risk of people becoming infected with it during that period.

“It’s very important for me to be clear that the risks would not be zero – that’s why we have to be very careful about any relaxation at Christmas, and people will have to think carefully about every relaxation, for what they want to do. or not. “

The First Minister was speaking in the hours before 11 council areas in western and central Scotland entered Level 4 – the toughest level of restrictions.

She also said in the First Minister’s Questions on Thursday that top medical officials of all UK nations have been tasked with developing a “concrete” proposal for the home mix.

All excuses you CAN leave a Level 4 area in Scotland

But the Scottish Tories said there were “serious legal questions” about the draft regulation, and questioned whether Ms Sturgeon had the power to say on what terms people could enter or stay in Scotland.

MSP Adam Tomkins, a law professor, said: “There are serious legal questions to be asked about the draft regulations published by the Scottish Government, which include rules about what can ‘enter or remain in’ Scotland .

“These rules appear to affect British and Irish citizens throughout the United Kingdom and Ireland.

“Is this within Holyrood’s jurisdiction? For one thing, freedom of movement will seem to be expressly reserved to the UK Parliament under the Scotland Act.

“For another, it is not clear that the Scottish Parliament can make rules contrary to the Common Travel Area, as agreed by the UK and Ireland.”

And Liberal Democrat MSP Mike Rumbles warned that “any self-respecting lawyer would advise a client not to pay a fine” while Scottish Labor leader Richard Leonard criticized the ban as “deeply flawed”.
