U.S. Navy veteran proceedings unaware of the 1995 HIV positive test file proceedings
A U.S. Navy veteran was unaware that he had co-existed with the AIDS-causing virus for over 20 years, as government health workers were not informed of positive test results in the mid-1990s.
In a federal proceeding filed this week, a South Carolina man said he had “real AIDS” because he was not treated after being stored in the dark.
“The treatment he’s receiving now is effective, but he’s basically been injured for 25 years because he hasn’t been treated,” McGowan said.
“I’m very guilty about the girlfriend he has over the last 25 years because he didn’t know,” he said.
The HIV test was conducted in November 1995 as part of a standard test at the US Department of Veterans Affairs Medical Center in Columbia, South Carolina, the proceedings said.

A veteran identified as John Doe to protect his privacy in the proceedings was injured when he appeared in the Navy in a 1976 ship accident.
According to McGowan, he was on board a destroyer that collided with an aircraft carrier off the coast of Scotland. Destroyer soldiers were told to abandon the ship. He and others were rescued from the North Sea.
McGowan said the ordeal caused clients post-traumatic stress disorders. He was classified as disabled due to physical and mental injuries and began to be treated by the Veterans Affairs Department.
A doctor at VA’s Colombian Medical Center requested a test, including an HIV test, in November 1995. The guidelines require patients to be notified that the test is positive and to start treatment. “Doe wasn’t informed about the HIV positive test until decades later, as it clearly violated standard care,” the proceedings said.
According to the medical records included in the complaint, in 2014 a nurse practitioner at a Colombian facility wrote a memo describing the 1995 examination. However, the complaint said the information had not yet been passed on to veterans.
In 2015, a veteran consulted another doctor through VA and recorded in medical records that he encountered a 1995 test result that tested positive for HIV. The doctor asked him who his infectious disease doctor was, and the veterans said he didn’t have. The doctor also asked the veterans if he knew he was HIV positive, and replied that he was never told about any positive tests.
The doctor said, “Don’t diagnose Mr. Doe with HIV, nor add HIV-positive tests to Dr. Doe’s problem list or medical history, and flag HIV-positive tests for subsequent donors. No, “the complaint said.
It was not until September 2018 that veterans made an emergency visit to a non-VA hospital (Mimonides Medical Center in New York City) to receive a definitive diagnosis and begin treatment for HIV / AIDS. At that point he responded well to antiretroviral therapy, but “the virus had already progressed to full-blown AIDS,” the complaint said.
“I suffered unnecessarily for decades with coexistence common to HIV-infected people, including lymphadenopathy, neurotoxoplasmosis, myalgia and arthralgia,” the complaint said.
