TikTok children's privacy complaint referred to US Department of Justice

The United States Federal Trade Commission (FTC) has filed a complaint with the Department of Justice (DOJ) against TikTok and its Chinese parent company ByteDance for potential violations of children's privacy.

The FTC says its own investigation “revealed reason to believe” that the companies “are violating or are about to violate the law.”

In a statement to BBC News, a TikTok spokesperson said it was disappointed by the decision.

The case is separate from legislation passed earlier this year banning TikTok in the United States if ByteDance does not sell the company.

The regulator said its investigation focused on potential violations of the FTC Act and the Children's Online Privacy Protection Act (COPPA).

The FTC also said that it does not typically announce that it has referred a complaint to the DOJ, but that in this case it felt it was in the public interest.

COPPA governs the collection, use and disclosure of personal information by online services about children under 13 years of age.

The FTC Act targets unfair or deceptive acts or practices by businesses.

In response, a TikTok spokesperson said the company disagrees with the allegations and has “been working with the FTC for over a year to address its concerns.”

“We are disappointed that the agency is pursuing legal action instead of continuing to work with us to find a reasonable solution,” they added.

A DOJ spokesperson told BBC News that they “cannot comment on the merits of the FTC's referral against TikTok.”

“Consistent with our usual approach, the Department of Justice consulted with the FTC prior to this referral and will continue to do so as we review the claims,” they added.

The FTC's announcement adds to the growing pressure facing TikTok in the United States.

In April, President Joe Biden signed a bill into law that gave ByteDance a maximum of one year to sell the app or face a ban in the country.

That means the deadline could be set in 2025, after the winner of the 2024 presidential election takes office.

The law was introduced to address concerns that TikTok could share user data with Chinese authorities – claims the company has denied.

In May, TikTok filed a lawsuit seeking to block the legislation, arguing it was an “extraordinary intrusion into the free speech rights” of the company and its 170 million followers. American users.
