The US president is seeking to right historic wrongs, allowing thousands of people to seek clemency and get their pay and benefits back.

President Joe Biden is offering pardons to veterans convicted under a now-repealed law banning homosexuality in the U.S. armed forces.

Biden announced in a statement released Wednesday that his act of clemency righted a historic wrong. The pardon could allow thousands of former military personnel to be court-martialled under laws making same-sex relations between consenting adults a crime.

Despite their courage and great sacrifice, thousands of LGBTQI+ service members have been forced to leave the military because of their sexual orientation or gender identity, the statement said. Some of these patriotic Americans have been court-martialed and have carried the burden of this great injustice for decades, Biden said in a statement.

The proclamation would affect those convicted of sodomy under Article 125 of the Code of Military Justice. The law took effect in 1951. It was rewritten in 2013 to prohibit only acts of force.

The majority were convicted before the military instituted the “Don’t Ask, Don’t Tell” policy in 1993, which made it easier for LGBTQ troops to serve if they didn’t disclose their sexual orientation. In 2011, Congress authorized their open military service.

The administration is considering ways to contact people who may benefit from a pardon.

Covered individuals can request proof that their conviction has been expunged and have their discharge from the military enhanced, allowing them to regain their pay and benefits.

The president's use of his pardon powers comes during Pride Month and days before he hosts a high-profile fundraiser with LGBTQ donors on Friday.

This is the third categorical pardon granted by Biden, who has expanded his pardon powers to cover a broad group of people convicted of particular crimes, including moves in 2022 and 2023 to pardon those convicted of possession marijuana.
