The European Commission plans to take Britain to court for failing to comply with EU laws on freedom of movement after Brexit.

In a blow to Sir Keir Starmer's efforts to reset relations with the bloc, the committee referred Britain to the European Union's Court of Justice, citing shortcomings in the way it cooperated with the post-Brexit withdrawal agreement.

The report argues that there are several shortcomings in the way the UK adheres to the Treaty on the Functioning of the European Union, which affects residents' rights to live and work freely across EU member states. Britain said in late 2020 it had failed to heed a series of warnings that its domestic laws did not comply with the EU's free movement laws.

The commission's complaints began in May 2020 when it accused the UK of restricting the right to free movement of EU citizens and their families. It sent a formal notice of complaint to the UK at the time, and in July this year it said several points remained unresolved, highlighting specific issues around EU citizens and their families exercising their right to free movement.

And on Monday the committee said it had carefully assessed the UK's response to the complaints, but argued that several elements of the complaints remain unresolved, including workers' rights and the rights of whānau.

Britain's referral to the bloc's highest court comes as a blow to Sir Keir's desperate bid for closer ties with the EU. The prime minister has spent much of his first six months in office courting European leaders in a bid to strike a new deal with the EU to cut the bureaucracy stifling post-Brexit growth.

It also comes after it emerged that Brussels is preparing to ask Britain to comply with EU law for the first time since Brexit as part of its new deal plans with the UK.

Sir Keir has repeatedly insisted the UK will not rejoin the single market in his lifetime, but has pledged to make Brexit a success by renegotiated the deal agreed by Boris Johnson and pursuing closer cooperation, particularly on defence, security and trade.

EU leaders plan to get Britain to recognize the jurisdiction of the European Court of Justice as a red line for improving trade relations, according to a blueprint for European negotiators reviewing the trade agreement seen by The Times.

The document also reportedly sets out UK concessions on fisheries and youth mobility plans as key priorities for the EU.

The document is due to be submitted to the European Council of Ministers next week ahead of formal talks between the UK and EU starting early next year.

Sir Keir and European Commission President Ursula von der Leyen agreed to hold regular EU-UK leaders' summits, with the first meeting scheduled for early 2025.

The UK government has been asked to comment.
