U.S. Supreme Court sides with Nebraska man who lost his home for more than $588

SCOTTSBLUFF, Neb. (WOWT) – A significant weight was lifted from one Nebraskan’s shoulders this month. His case of injustice went all the way to the United States Supreme Court.

First Alert 6 Investigates has been following Kevin Fairs' legal trail for years. But as his case finally comes to an end, his health has taken a major turn and he needs a different kind of help: legal help.

Fair and his wife lived in their Scottsbluff, Neb., home for nearly 30 years. In fact, they had paid for it. It was worth $60,000, according to the appraiser.

But when Fair got sick, they fell behind on property taxes, to the tune of $588.

Nebraska law allowed a private investor to eventually pay off their tax debt to Scottsbluff County and take ownership of the property.

Fair said that wasn't right, so he took the case to the U.S. Supreme Court. The justices ruled that the scenario effectively violated the Constitution and that the government could not take more than what was owed.

It's difficult to measure the real impact of the real threat of losing your home, a home you paid for, on mental and physical health.

From the beginning, Fair told First Alert 6, the law defied common sense.

“They have everything to make money, and I will have nothing left after 25 years of living here,” he said.

Just before Christmas, the Scottsbluff man learned that the investor had surrendered the title and the house was Fair Trade again.

He is grateful and there has already been a show of support, said Christina Martin, senior attorney at the Pacific Legal Foundation.

What was commonly called theft of home securities is no longer constitutional. It's unclear how many, like Fair, will not have to endure the heartbreak of losing their homes.

But as one fight ends, another fight begins: Kevin Fair had a stroke last month and now needs a ramp to get into his house.
