The transfer of Ridah bin Saleh al-Yazidi from the US military prison in Cuba is the fourth in two weeks by the outgoing Biden administration.

The Pentagon has released a Tunisian detainee held at Guantanamo Bay since the notorious prison camp's first day in 2002, without ever being charged.

Ridah bin Saleh al-Yazidi was repatriated Monday from the American military prison in Cuba to Tunisia, the American Department of Defense said in a statement.

The transfer is the fourth in two weeks made by the outgoing Biden administration in an effort to reduce the population of military prisons, which held 40 prisoners when Biden took office in 2020.

Al-Yazidi was deemed eligible for transfer following a rigorous interagency review process.

On January 31, 2024, Secretary of Defense [Lloyd] “Austin has informed Congress of its intent to support this repatriation and, in consultation with our partner in Tunisia, we have met the requirements for a responsible transfer,” the Pentagon said.

Al-Yazidi, 59, has never been charged with a crime by the United States and his transfer was approved more than a decade ago, but no deal with the Tunisian government was reached until now to bring him back to his country.

Pakistani soldiers captured al-Yezidi near the border with Afghanistan in December 2001, and he was suspected of being an al-Qaeda fighter, the New York Times reported.

Twenty-six detainees remain at Guantanamo Bay, 14 of whom are eligible for transfer, the statement said.

Three detainees are eligible for periodic review of their status, seven are currently involved in the military commission process and two detainees have been convicted and sentenced, the statement added.

Al-Yazidi was sent to the prison on the day it opened, January 11, 2002, to house detainees captured during the so-called U.S.-led war on terror after the September 11, 2001, attacks.

Located on the U.S. military base in Cuba, the prison operates under a legal system run by military commissions that do not guarantee the same rights as traditional U.S. courts.

Detainees cleared for release sometimes spend years at Guantanamo as Washington searches for countries to take them in after their release, with some governments reluctant to take them back or take them in.

Guantanamo Bay once housed nearly 800 prisoners, many of whom first spent time in secret CIA locations known as black sites, where some were tortured under an authorized enhanced interrogation program by the administration of former President George W. Bush.

The facility has become an enduring symbol of American abuses during this era. President Barack Obama, who succeeded Bush, promised to close the facility, but failed largely because of legal red tape and domestic political opposition.
