Predators who create sexually explicit deepfakes could face prosecution as the government cracks down on vile online abuse as part of its mission to make the streets safer.
The spread of these surreal images has grown at an alarming rate, causing enormous harm to victims, especially the women and girls who are often targeted.
To address this issue, the government will not only crack down on this abhorrent behavior, but also make it clear that there is no excuse for creating sexually explicit deepfakes of anyone, while also ensuring that perpetrators can be prosecuted for creating and sharing these images. It will introduce a new crime of significance. their consent.
The Government will also send a clear message that abusers will face the full force of the law by creating new offenses for taking intimate images without consent and installing equipment with the intent to commit these offences.
Victims Minister Alex Davies-Jones said:
It is unacceptable that one in three women are victims of online abuse. This degrading and disgusting form of nationalism must not be normalized, and as part of our plan for change, we are cracking down on violence against women in all its forms.
These new crimes will help prevent people from being harmed online. We will issue notices to violators and they will be subject to the full force of the law.
Sharing or threatening to share intimate images without consent is already a crime, but under certain circumstances, such as upskirting, taking images without consent is also a crime.
Under the new offense, anyone who takes intimate images without consent will face up to two years in prison. Anyone who sets up a device that allows intimate photos of themselves or others to be taken without consent can also face up to two years in prison.
The move follows the government's declaration to ban the creation of sexually explicit deepfakes and the recommendations of the Law Commission on Intimate Images.
Together with the existing offense of sharing intimate images without consent, this will provide law enforcement with a holistic offense package to effectively address non-consensual intimate image abuse.

The rise in intimate image abuse is a terrible trend that exploits victims and perpetuates a harmful online culture. These actions are not only cowardly, they cause serious harm, especially to the women and girls who are disproportionately targeted.
With these new measures, we have sent a clear message: Creating or sharing these vile images is not only unacceptable, it is a crime. Technology companies must also step up. Platforms that host such content will face increased scrutiny and significant penalties.

Intimate image abuse is a national emergency, causing serious and long-term harm to women and girls who have completely lost control of their digital footprints at the hands of online misogynists.
Women should not accept sexual harassment and abuse as a normal part of online life. We need urgent action and legislation to better protect women and girls from the massive scale of misogyny they experience online.
These new offenses follow government action in September 2024 to add the offense of intimate image sharing as a priority offense under the Online Safety Act. This places the burden on platforms to eradicate and remove this type of content. Failure to do so will result in enforcement action from Ofcom.
The new offenses will be included in the Government's Crime and Policing Bill and will be introduced as parliamentary time allows. Further details on the new offenses will be announced in due course.

The sexually explicit deepfake offense applies to images of adults. This is because the law already covers this practice if the images are of children (under 18 years of age). It is already an offense under the Sexual Offenses Act 2003 to share or threaten to share intimate images, including deepfakes, following changes made by the Online Safety Act 2023. The government will abolish two existing voyeurism offenses involving video recordings. A person who performs a private act and records an image under that person's clothing.
