The United States deports hundreds of Venezuelans in Salvador, despite the ordinance of the judge

In an unprecedented decision, more than 250 Venezuelans were expelled by the United States and sent to Salvador, where they were transferred to a maximum security prison, President Salvadoran Nayib Bukele and US Secretary of State Marco Rubio confirmed on Sunday.

The Trump administration accused them of being members of the criminal gang of Tren of Agua, invoking the law on extraterrestrial enemies of 1798 to expel them, which was only used three times in American history.

Tren de Aragua is from a sadly famous prison in the central state of Aragua and is linked to the abduction, extortion, organized crime and contract murders.

Bukele announced via the social network X that 238 alleged members of the Venezuelan gang had arrived in his country and had been transferred to the center of confinement of terrorism (CECOC), a mega-prison with a capacity of 40,000 detainees, where they will remain for a period of one year which could be renewed.

A video shared on Bukele's social media shows detainees with hands and feet chained escorted by armed plane officers. Some are placed in armored vehicles, while others, curved while the officers push their heads down, are forced from bus.

The Act respecting extraterrestrial enemies, invoked during World Wars I and II and the War of 1812, forces a president to declare that the United States is at war, giving it extraordinary powers to hold or withdraw foreigners who would have protections under immigration or criminal laws. It was used for the last time to justify the detention of Japanese-American civilians during the Second World War.

The ACLU, which filed the trial which led to the temporary ban on Boasberg on deportations, said that it asked the government if the moves in Salvador were in defiance of the court.

The Government of Venezuelas, in a declaration, rejected Sunday the declaration of the law of the use of Trumps, characterizing it as evocative of the darkest episodes of human history, from slavery to horror of the Nazi concentration camps.

The Trump administration did not identify the expelled migrants, or provided evidence that they are members of Tren from Aragua, or that they have committed crimes in the United States. He also sent two high-level members of the Salvadoral Gang MS-13 to Salvador who had been arrested in the United States.

Immigration lawyers said on Friday, they noticed that the Venezuelans who could not be expelled under the immigration law were moved to Texas for expulsion flights. They started to bring prosecution to stop transfers.

He noted that the law had never been used previously outside a war held in Congress and that the applicants could successfully affirm that Trump has exceeded his legal authority to invoke it.

The deportation bar represents up to 14 days and migrants will remain in police custody during this period. Boasberg planned an audience on Friday to hear additional arguments in the case.

He said he had to act because migrants whose deportations could in fact violate the Constitution deserved a chance to have their pleads heard in court.
