The two countries agreed in 2019 to a joint action plan outlining external cooperation, but did not allow one country to bring people rescued in the English Channel to the other's port.

Richard Tice has repeatedly claimed that he was advised that it would be legal, but there has been no response to requests to see that advice.

We asked the British Home Office and French authorities whether Britain had a legal right to take people away and send them back to France, but they had no answer.

In July, British Border Force vessels were deployed off the Gravelines coast in northern France to support French search and rescue operations.

The British ships, along with the French ships that accompanied them, took the rescued men to Calais.

Mr Turner explained that this could happen because the British ships were assisting the French rescue operation and were in French waters with French permission.

Prime Minister Keir Starmer stressed that this was an operational decision taken at the time and not a change in policy.

In 2021, the UK government considered returning small vessels seized in the English Channel, but the plan never came to fruition.
