60 other civilians, including Imran Khan's nephew, sentenced over May 9 riots
ISLAMABAD: Pakistan's military courts have sentenced 60 more civilians to prison for their alleged involvement in violent attacks on military sites during the May 9, 2023 nationwide riots, the Express Tribune reported, citing an Inter announcement -Public Relations Services (ISPR). ) THURSDAY.
According to the Express Tribune, this follows an earlier announcement by the ISPR that 25 people had been convicted for their role in the same incidents. Among the 60 people sentenced was Hassan Niazi, nephew of former Prime Minister and founder of Pakistan Tehreek-e-Insaf Imran Khan. Niazi was sentenced to 10 years in prison.
The convictions relate to alleged attacks on important military and government installations, such as the Corps Commander's House in Lahore, the General Headquarters (GHQ) in Rawalpindi, the ISI office in Faisalabad and Bannu Cantt, among others.
According to the ISPR statement, Field's general court martial handed down the sentences after “considering all the evidence” and ensuring that legal rights were respected throughout the process and further emphasized that all Convicted persons had the legal right to appeal. “Following the announcement of the sanctions on May 9 in light of the Supreme Court's decision, the Field General Court Martial promulgated the sanctions against the following 60 remaining culprits after considering all the evidence, ensuring the granting of full legal rights to the convicts, completion of due process and appropriate judicial procedures,” read the statement cited by the Express Tribune.
Additionally, army media reported that proceedings against nine other people involved in the May 9 riots had been completed. “The nation, government and armed forces remain resolute in their commitment to ensuring justice and upholding the inviolable authority of the state,” the ISPR said.
Meanwhile, the United States and the United Kingdom have raised concerns over the sentencing of civilians by military courts in Pakistan, following similar statements by the European Union (EU). The US State Department has expressed deep concern over the use of military courts to convict civilians, criticizing the lack of judicial independence, transparency and due process. The United States has called on Pakistani authorities to respect the right to a fair trial guaranteed by the Pakistani Constitution.
“These military courts lack judicial independence, transparency and due process guarantees,” the Express Tribune quoted the United States as saying. “The United States continues to call on Pakistani authorities to respect the rights to a fair trial and due process, as enshrined in the Pakistani Constitution,” the statement added. Similarly, the UK's Foreign, Commonwealth and Development Office (FCO) said military trials of civilians lacked transparency and independent oversight, undermining the right to a fair trial.
“We call on the Government of Pakistan to respect its obligations under the International Covenant on Civil and Political Rights,” read the FCO statement, cited by the Express Tribune. Previously, the EU had also expressed concerns over the conviction of civilians by the military court, stressing that the verdicts were incompatible with Pakistan's commitments to ensure a fair and public trial.
The EU statement also highlights that Pakistan's obligations under the International Covenant on Civil and Political Rights are part of its commitment to the GSP+ trade agenda, which requires the implementation of key international conventions.
“The European Union notes with concern the conviction of twenty-five civilians by a military court on December 21 in Pakistan,” we read in a press release published by the European External Action Service (EEAS) in Brussels. “These verdicts are considered inconsistent with Pakistan’s obligations under the International Covenant on Civil and Political Rights (ICCPR),” the statement added.
In response, Pakistan's Foreign Ministry clarified that the verdicts of the military courts were issued in accordance with a law passed by Parliament and the decision of the Supreme Court of Pakistan.
