Imran Khan moves the Supreme Court against the transfers of high court judges

The founder of Pakistan Tehreek-E-insaf (PTI), Imran Khan, filed a request on Thursday before the Supreme Court, contesting the recent transfer of judges from the High Court to the High Court of Islamabad (CIH), arguing that it compromises judicial independence.

The petition, deposited under article 184, paragraph 3, of the Constitution, seeks to declare the notification of February 1 by the ministry of Law, which transferred judge Sardar Muhammad Sarfaraz Dogar from the High Court of Lahore (LHC), judge Khadim Hussain Soomro of Sindh High Court (SHC), and judge Muhammad Balochistan (BHC) and Muhammad Astif empty.

Khan argued that these transfers were punitive measures against judges who had resisted external pressures, referring to letters written by IHC judges to the former chief judge of Pakistan concerning an alleged induence interference. He alleged that transfers were intended to pack the judicial power with judges favorable to the executive, eroding public confidence in the courts.

The petition also disputes the appointment of a freshly transferred judge as an acting chief of the IHC without the oath and reconstruction of the administrative committee of the Court, removing the existing members and replacing them by newly transferred judges.

Khan asked the court to ensure that legal transfers remain transparent, advisory and justified in the public interest, in accordance with the principles established in the Al-Jehad Trust case. The case should arouse a debate on judicial independence in Pakistan.
