Appeal in Imran Khan Al-Qadir case: IHC gives defense two weeks for final arguments

The Islamabad High Court on Monday gave former Pakistani Prime Minister Imran Khan and his wife Bushra Bibi two weeks to begin final arguments in their appeal against the conviction in the £190 million Al-Qadir case.

The court also dismissed contempt of court motions filed by the former first couple after noting that powers of attorney and other documents at the center of the dispute had already been signed.

Khan and Bibi were found guilty by an accountability court in Islamabad on January 17 last year in a complaint filed by the National Accountability Bureau, Pakistan’s anti-corruption body. Khan was sentenced to 14 years in prison, while Bibi was sentenced to seven years.

A two-member bench comprising Chief Justice Sarfaraz Dogar and Justice Muhammad Asif first considered the contempt petitions. The petitions alleged that prison authorities were not allowing lawyers to obtain signatures on a power of attorney and other documents from Khan and Bibi, who are incarcerated in the high-security Adiala prison in Rawalpindi. The court said the motions had become infructuous as the documents were now signed.

The court then turned to the main appeals and ordered the defense to begin its arguments. After hearing arguments from Khan’s lawyer, the court agreed to give the defense two weeks to begin final arguments on the conviction appeal. Khan’s sister Aleema Khan and several party leaders were present during the hearing.

The Al-Qadir case focuses on allegations by the National Accountability Bureau that Khan’s government facilitated a deal in 2019 with property tycoon Malik Riaz to use 190 million pounds to settle a fine imposed on him by the Supreme Court. The money had been seized by the United Kingdom’s National Crime Agency and transferred to the Pakistani government. The businessman reportedly donated over 57 acres of land for the construction of the Al-Qadir University Trust, chaired by Khan and Bushra Bibi.

Khan, 73, has been in prison since August 2023 in several cases, including corruption, leaking state secrets and illegal marriage. He denied the allegations. Monday’s hearing ended with the High Court rejecting contempt appeals and giving the defense two weeks to begin final arguments in Al-Qadir’s appeal.
