The earthquake response claims settlement package for the South is estimated at $313 million

The package for some Southern Response document holders could cost $313 million, if all eligibles apply.

Southern Response is the government-owned company responsible for settling claims by AMI policyholders for Canterbury earthquake damage.

In December, Minister Responsible for the Earthquake Commission David Clark announced a package for plaintiffs who had settled their claims prior to October 2014.

This comes after a landmark Supreme Court case, which found that Southern Response misled and deceived Carl and Alison Dodds. The couple accepted an offer of about $200,000 less than the top secret estimate to fix their home, despite having “the best insurance policy money can buy.”

The package offers an additional payment to customers in a similar situation, with payments that include professional fees, a contribution to legal fees, unpaid contingencies, and interest.

“Southern Response has worked with its actuaries to estimate the payments likely to be made under the approved package. We are now in a position to publish a cost estimate for the full package,” Clark said.

Based on actuarial advice, Southern Response includes a cost of $242.5 million in its accounts, reflecting an estimate of 75 percent of the package.

Clark said some eligible customers may have since moved abroad or changed their data, but Southern Response will continue to look up their contact information if they qualify.

“Southern Response is a large scale advertising campaign and direct contact to reach as many people as possible, if court approval is granted.”

The package may also affect people who are part of a Ross class action lawsuit, and Southern Response is seeking court confirmation that it can communicate with these policyholders about the package.
