New laws introduced to crack down on fraud

New legislation to tackle fraud in the social security system, giving the DWP more powers to catch fraudsters quicker and stop customers falling into debt faster, includes measures to protect vulnerable customers and provide support to those who need it most.

The bill is expected to save $1.6 billion over the next five years and will expand and modernise the DWP’s powers to tackle fraud, recover money lost to fraud and protect vulnerable customers from debt.

Fraud and errors in the Social Security system currently cost taxpayers an estimated $10 billion a year, and since the pandemic began, a total of $35 billion in taxpayer money has been stolen from those who need it most.

The nature of fraud has also become more sophisticated, meaning without new statutory powers the DWP will not be able to enforce its enforcement in line with the changing nature of fraud.

The Bill gives the DWP the powers to:

Better investigate suspected fraud and new search and seizure powers to give DWP greater control over investigations into criminal gangs defrauding taxpayers. Provide greater fairness in debt recovery by allowing DWP to collect debts from individuals who could pay but did not. Require banks and financial institutions to share data that could show signs of potential benefit overpayments.

The bill will also include safeguards to protect vulnerable customers. Staff will be given the highest level of training on the appropriate use of new powers, and new oversight and reporting mechanisms will be introduced to monitor these new powers. The DWP will not have access to people’s bank accounts and will not share personal information with third parties.

Additionally, we will provide additional assurances about the safe use of powers by submitting a code of practice that will be consulted on as the bill progresses.

This Bill fulfills the Government’s stated commitment to protect taxpayers’ money and demonstrates the Government’s commitment to not tolerate fraud, error or waste anywhere in our public services, including our social security system.
