American travelers fear crossing American borders under increased verification
Can a border patrol officer look through your phone and other devices?
Customs and American border protection agents can go through your phone, including all items deleted on the device.
American citizens and legal residents experience increased anxiety about trips due to the increase in immigration examination in the Trump administration.
Upon his return to the United States since the worst scenario of Curaao Spring Break, Keylin Rivera's scenario has become true.
Rivera, a Double American and Colombian citizen, had avoided Charlotte, North Carolina, Friday for a stopover before returning to Boston. It crossed the world entry line for border control at Charlotte airport. But when she put her passport in the kiosk, it pointed out to see an officer. This has happened before, but the police generally take a look at her document and let her pass, so she didn't think about it much.
However, this time, she was taken to a back room where she was questioned about her trip, and her bags were searched under what they told her to be random research. Rivera asked for her passport and resumed her return trip, but she always feels unstable of the incident.
“There is so much uncertainty, we do not know what could happen, and I was really worried about traveling in general, to stop, which I stopped,” Harvard graduate and former politics under the administration of Biden told USA. “I was already preparing for that.”
Before landing in Charlotte, Rivera “prepared for the worst” by removing all his social media applications and withdrawing the identifier from her phone. She sent an SMS to her friends when she was reported, just in case something serious happens.
“I guess my question is, why wasn't he someone else? Why was I the only one?” She said.
In the midst of recent news of detainees, deportations and a higher immigration examination under the Trump administration, the Americans feel increased anxiety about the American borders. Even those who have valid visas to study, work and live in the country feel pressure. Travelers rethink any international trip to come for fear of being arrested or worse.
“The officers are encouraged by this administration not to leave a stone not returned and to ensure that they ask questions and collect information, so I think that people who had previously encountered any problem could see this change,” said Glenn Scieck, an immigration lawyer in Harter Secrest & Emery LLP, who works in close collaboration with foreign residences with residences with residences permanent or visas. “We are going on the whole, just seeing more at the border.”
“An emphasis on an improved verification”
Recently, legal residents have been faced with detention or expulsion while the Trump administration is responsible for increasing national security and treating public security threats, as indicated in an executive decree of January 20, including a complete examination of visa emission programs and a probable travel ban on more than 40 countries.
“The United States must ensure that foreigners admitted and extraterrestrials otherwise already present in the United States do not have hostile attitudes towards its citizens, culture, government, institutions or founding principles, and do not argue, help or support designated foreign terrorists and other threats to our national security”, according to the order.
“What we know is that under this administration, the emphasis is put on what is called improved verification, which is essentially a directive that immigration agents should approach people entering the United States with in-depth examination,” said Scieck. “So, I think the officers may ask questions about things that might not have tackled their radar. And now it's a problem in this new type of increased control.”
Earlier this month, Lebanese doctor and professor at Brown University Rasha Alawieh came back from a visit to her home when she was owned at Boston Logan International Airport by US customs and border protection for Hezbollah media on her phone. Her visa has been canceled and she has since been expelled.
Universities across the country have warned international students to rethink travel plans outside the country after those who were frank against political conflicts, in particular the War of Israel-Hamas, hunted by ice. A student from the 21-year-old South Korean University of Columbia named Yunseo Chung, who has lived in the United States since she was a child, faces expulsion and an Indian doctoral student was recently self-supported in Canada.
These high-level cases contribute to fear and uncertainty that many Americans feel what could happen if they try to leave or return to the United States, in particular with reports of border control agents that are increasingly looking for travelers' devices.
“It's just that things change so quickly; there is a lot of reports,” said Scieck. “People just don't know if they go to the border problem or not.”
Although they are legally authorized in the United States, these high-level cases highlight the verification of legal residents and non-residents, in particular those of H1B visas (work), student visas or green cards, according to Lynn Damiano Pearson, senior lawyer for the National Immigration Law Center. “There have certainly been examples of extreme climbing increased control and more difficult actions against people who have a valid form of immigration,” she said.
If the proposed travel ban is implemented, which could be as soon as Friday, there could be an internal application or a cancellation of visas on legal immigrants from the countries listed given the language in the decree, but it is too early to say.
Those who live in American territories like Porto Rico or Guam “should absolutely not have to have problems through borders, since they are American citizens, added Pearson. “However, when we see this meticulous examination, we also see racial profiling.”
“The very fact that we have this conversation on citizens … The two really show climbing, but also show how the rights of American citizens are linked to the rights of immigrants, all our rights are interspersed and all affect us,” said Pearson.
'Really worried'
Ginny Williams, an American independent writer with double citizenship in the United Kingdom, has lived in Kent for more than a decade, but has had to return to the United States for six months to visit her parents. She and her husband born in the United Kingdom have already had immigration problems when they tried to get her permanent residence. The new administration policies only exacerbate its fears back to the United States.
“These historical things always make me a little nervous at the idea of going back and now with everything that is happening, I am really concerned about the return,” she said, adding that it feels like it was trapped and unable to travel during the pandemic, but this time, it is at home and because of politics.
His return home feels necessary, given the drop in his father's health. “As much as I hate saying it, if that was not the case, if my parents were not old, I would not come back,” she said. “It is six months old, and so much can change today.”
Williams plans to remove his social media as traveling, just to be safe.
Few is certain for the moment because the circumstances continue to evolve. “What is clear is that border officers have a large discretionary power investigating, to ask questions to ensure that they understand someone's goal of someone in the United States,” said Schieck. “And this is a very wide level of discretion, whether you have an American citizen or a permanent resident.”
He recommends that people be as honest and prepared as possible when they arrive at the border to articulate the reason why they enter the United States and transport all documents to argue that their statements are true. “If someone is noted to make a false statement, this can cause very, very serious immigration consequences,” he added.
A British tourist who was doing household chores for foster families during a hiking trip was detained in Washington for weeks after being refused the entry to Canada for “an incorrect visa”.
According to Pearson, holders of green cards who had previously had no problems of crossing borders should still be able to travel gently as long as their documents are in order and up to date, know their rights at the border (such as the right to request a lawyer) and consult an immigration lawyer.
Rivera feels discouraged and exhausted not only from the stress of the in -depth examination of the administration, but also of the later political division. “I wish (the administration) would not see other people who oppose their point of view like the enemy because I am not your enemy, I am really rooted for you, I want you to succeed,” she said.
This week, she leaves the country again for a trip with a friend, but she feels more nervous after the incident last weekend. “I just have more anxiety around traveling. I know that I do nothing wrong. I am not breaking any laws. I am an American citizen,” she said. “I hate that the joy I had while traveling is somehow torn from me.”
