The Pritzker administration aims for equal wages and introduces new legislation to close wage gaps
Springfield, Illinois — New Illinois legislation aims to close the gender pay gap.
After Governor Pritzker signed SB1847, companies with more than 100 employees will need to provide workers and their wage details to the Illinois Department of Labor (IDOL) from 2022 onwards.
Companies need to provide information such as employee race, ethnicity, gender, salary / hourly wage, and so on.
Future changes will require qualified private employers to submit information in line with the current requirements of the Equal Employment Opportunity Commission (EEOC).
The law is an initiative of the Illinois Legislative Black Caucus, originally passed in January 2021 as part of the Equity Pillar Act.
Companies with more than 100 employees in Illinois as of March 23, 2021 will receive an Equal Pay Registration Certificate (EPRC) between March 24, 2022 and March 23, 2024. You need to apply.
Eligible companies that will be operational after March 23, 2021 must apply for the same wage registration certificate within three years, but not by January 1, 2024.
The same wage information collected by IDOL includes:
• A copy of EEO-1 submitted to the EEOC
• A list of all employees over the past year, sorted by gender, race and ethnicity
• The county where the employee works
• Date when the employee started the business
• Additional information that may be needed to determine if equal pay for equal work exists
• Equal wage compliance statement signed by an authorized agent of the business
The EPRC application must be completed online. The Illinois Department of Labor will provide additional guidance regarding the application process.
