IHC withdraws objections to appeals against convictions of Imran and Bushra Bibi in Toshakhana II

ISLAMABAD: The Islamabad High Court (IHC) on Thursday issued a written order removing the office’s objections to appeals filed by Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan and his wife Bushra Bibi against their convictions in the Toshakhana-II case.

Justice Khadim Hussain Soomro issued the written order relating to the proceedings held on March 12, allowing applications for excuses for the delay in filing the appeals and directing the Registrar’s Office to assign regular numbers to the appeals.

The court found the explanation given by appellants’ counsel for the alleged delay to be satisfactory and ordered that all objections of the office be waived. According to the order, defense counsel argued that the appeals were filed within the statutory statute of limitations of 30 days following the trial court’s ruling.

He further submitted that there was no legal requirement to file a fresh power of attorney (vakalatnama) in the High Court, where a lawyer had already represented the accused during the trial.

The registrar’s office had objected to the absence of a newly signed vakalatnama. The lawyer informed the court that several attempts were made to obtain the signatures of the appellants in prison, but the prison authorities, especially the prison superintendent, did not facilitate the process.

The lawyer also argued that the remaining objections were purely technical in nature and could not justify the return of the appeals. He argued that once an appeal was filed, the Registrar’s Office was required to submit it to the court with all objections, while whether those objections were valid should be decided by the court on the judicial side.

The order noted that an appeal constituted a continuation of the trial and granted the appellant the legal right to request a reevaluation of the evidence. The court noted that this right cannot be denied on purely technical grounds and that appeals must be decided on their merits after hearing both parties.

An accountability court had sentenced Imran Khan and Bushra Bibi to 10 years’ imprisonment each, along with fines, on December 20, 2025. The couple filed their appeal before the IHC on December 29, 2025.
