By entering the prosecutor’s “trap”, Doctor Tifa will have difficulty fighting the Jokowi certificate case
The Attorney General (JPU), through his indictment, is considered to limit the resistance maneuvers of Tifauzia Tyassuma or Doctor Tifa in the diploma case of the 7th Indonesian President Joko Widodo (Jokowi). According to Ade, Doctor Tifa’s legal team will only be able to test the relevance of the evidence and the construction of the indictment, and not develop a defense beyond the accused elements.
“Because later, when the resistance is carried out by related parties, we will all know that those who fight against the accusations cannot be outside the accusations. At least regarding the accusations, of course, we will explain the evidence that evidence A, evidence B, evidence C are irrelevant,” he said, quoted Monday (6/7).
Ade even considers that the construction of the indictment led to a maximum criminal threat if all the elements of the indictment were declared proven at trial.
During the first trial, the prosecutor reportedly said that the fake diploma case could not be proven by Doctor Tifa.
The prosecutor also said that the accusations contradicted the facts known to the accused and were therefore considered an attack on the honor or reputation of Joko Widodo (Jokowi).
Additionally, the indictment also contains the results of a forensic laboratory examination which found that the former president’s diploma was identical to 14 comparative documents.
Based on these results, Doctor Tifa was accused by the prosecutor of using Article 434 paragraph (1) in conjunction with Article 441 paragraph (1) in conjunction with Article 126 paragraph (1) of Law Number 1 of 2023 regarding the Criminal Code.
However, the influencer still chose to fight the accusations. Before the jury, he stated that he would not accept restorative justice, that he would file an exception and refused to do so. plea bargain or a guilty plea.
