Three police officers suspended and investigated after dismissal of “King Khan” case

Three police officers have been arrested and are being investigated after failing to appear in court, leading to the dismissal of a drug case against Imran Khan, also known as “King Khan”.

The police did not attend the trial despite being summoned to testify, which prevented the prosecution from pursuing its case.

Police spokesperson Ana Naisoro confirmed that Police Commissioner Rusiate Tudravu had interdicted the three officers and asked the internal affairs unit to investigate their absence.

“The three men were interdicted and Home Affairs was tasked with investigating their absence,” Ms Naisoro said.

The case against Khan was dismissed by the Nasinu Magistrate’s Court last Friday after three of the five prosecution witnesses failed to appear. Arrest warrants were issued for the absent police officers before the case was dismissed under section 166 (2) (a) of the Criminal Procedure Act.

Khan was charged with unlawful possession of illegal drugs after he was found in possession of 3.49 grams of methamphetamine in 2021.

However, the Office of the Director of Public Prosecutions (ODPP) has confirmed that the case is not over and is currently reviewing the case with a view to refiling the charge.

“ODPP has communicated with prosecution witnesses and is reviewing the matter to re-indict the accused.”

The ODPP said criminal trials rely largely on the appearance of prosecution witnesses and cases could be significantly affected when witnesses fail to appear.

He said the state remains committed to ensuring witnesses are properly called and witness conferences are held before trial to help present evidence effectively.
