Trump’s request for reconsideration of $5 million verdict in E. Jean Carroll case could be considered by justices in August

Three days after the Supreme Court issued its first round of summer orders, President Donald Trump’s request for the Supreme Court to reconsider its decision to uphold the 2023 verdict against him in a civil suit filed by E. Jean Carroll was circulated to the justices. This means the court could grant Trump’s request for the next round of summer orders, which are expected to be issued on Monday, August 17.

Carroll filed the complaint that led to Trump’s petition in a New York federal court in 2022. She alleged that Trump sexually assaulted her in a dressing room at a Manhattan department store in 1996, then defamed her in 2022 after she made his assault allegations public. A jury ultimately awarded Carroll $5 million, and the U.S. Court of Appeals for the 2nd Circuit upheld that verdict.

Trump appealed to the Supreme Court last fall. He argued that Carroll’s lawyers should not have been allowed to introduce testimony from other women who also alleged Trump assaulted them, as well as the 2005 “Access Hollywood” tape in which Trump bragged about grabbing women by their genitals.

In his brief urging the court to deny Trump’s motion, Carroll countered that while the jury should not have been allowed to consider the evidence, it ultimately would not have made a difference because the rest of his argument was so strong.

Trump’s original motion for review was first circulated for the justices’ conference on February 20, 2026, but the court postponed it several times, finally considering it at the June 25 conference and rejecting it on June 29. Trump then filed his request for a rehearing on July 8.

The judges have not granted a request to reconsider their refusal of review since 2018.
