Judge hears arguments over Brendan Sorsby’s request to play next football season
LUBBOCK, Texas (KCBD) – A hearing began Monday at 9 a.m. to determine whether Texas Tech quarterback Brendan Sorsby can play college football while his lawsuit against the NCAA moves through the court system.
Judge Ken Curry, a retired Tarrant County judge and graduate of Houston Law School, is appointed to preside over the case in Lubbock County’s 99th District Court.
Last month, the NCAA declared Sorsby permanently ineligible for gambling, including betting on his own team. Sorsby filed a request for a court order allowing him to play during the legal proceedings.
He completed a gambling rehabilitation program last week.
Court documents filed by the NCAA show Sorsby placed thousands of sports bets between 2022 and 2026 while at Indiana, Cincinnati and Texas Tech.
According to the documents, Sorbsy bet on college sports, including bets on Indiana football, his own team and bets on the performance of his teammates.
The NCAA says Sorsby later moved to other people’s accounts and apps to place bets, including after transferring to Texas Tech, where online sports betting is illegal under Texas law.
Monday’s arguments
Jeffrey Kessler, an attorney representing Sorsby, said the temporary injunction should be granted because the NCAA has failed to enforce the reinstatement process.
Kessler cited the NCAA Constitution and Bylaws, including Article 1, Section D, which states that the welfare of student athletes is designed to protect their physical and mental health.
“The mental health of the athlete is key here,” Kessler said. “We have Sorsby, who has been diagnosed with mental addiction, he should be supported here.”
Kessler said Sorsby did not engage in gambling activities that threaten the integrity of any game.
He said the NCAA’s recovery guidelines state that the Division 1 committee will prioritize the well-being of student-athletes. He said the NCAA did not consult a professional about Sorsby’s mental health status and instead declared him permanently ineligible because he had bet on his team before he was an active member.
At the time of Sorsby’s Indiana football betting, he was practicing but not traveling for road games, Kessler said. He said Sorsby stopped betting on Indiana two weeks before his lone appearance of the 2022 season.
Kessler said Sorsby never gambled on the team in any game he participated in, which is not disputed by the NCAA. He said Sorsby never posted Indiana information to anyone else to give them a gambling advantage.
Kessler said the same was true in Cincinnati and that Sorsby never gambled on Texas Tech.
“Based on these facts, there can be no doubt that there was no competitive integrity issue,” Kessler said.
A clinical report from Sorsby’s residential treatment program shows a diagnosis of gambling disorder and anxiety, Kessler said. He said it is undisputed that Sorsby has a mental disorder.
Kessler said Sorsby is fully committed to continuing therapy for a full recovery and that nothing should stand in the way of his recovery.
If the judge denies Sorsby’s request for an injunction, he could file the NFL’s supplemental draft.
