‘It’s not science, it’s enforcement’: Health experts slam RFK Jr.’s Hantavirus isolation order Hantavirus
Health law experts say the Trump administration has imposed an “authoritarian” and “unconstitutional” quarantine on at least one person who came into contact with a hantavirus patient.
The reimposed quarantine, without any scientific evidence, sheds light on how the United States will respond to future cases of Ebola and other pathogens in the United States and sets a precedent for detaining Americans without a scientific basis.
Lawrence Gostin, a health law professor at Georgetown University Law Center, said that “recklessly detaining someone without probable cause, without a crime, without a significant public danger” is “arbitrary, capricious and unjust.”

Angela Perryman, an American passenger on the cruise ship MV Hondius, came into contact with another passenger who was infected with Andes virus, a type of hantavirus. The U.S. Centers for Disease Control and Prevention (CDC) has asked states to check passengers for symptoms and provide 24-hour security, an unusual step, especially for a pathogen like the Andes virus, which typically only transmits from person to person.
“This is not the kind of thing that requires as much isolation as what we’re seeing here,” Hodge said.

“In the absence of adequate home monitoring by state authorities, an executive quarantine order is necessary to ensure the health of Mr. Perryman and the community,” she added.
The agency did not respond to the Guardian’s questions about why President Kennedy overruled the CDC and whether this set an unconstitutional precedent in response to other pathogens.
Authorities are intended to use the least restrictive options available to contain health threats to public health. That means, Hodge said, that if you have multiple options that are effective at limiting the spread, “you’re going to choose the one that’s less restrictive on civil liberties and rights violations.”
Hodge said the situation is “highly unusual” for the CDC. State and local authorities typically establish quarantine and isolation measures. The CDC may provide guidance on doing so. But now, Hodge said, “even though state and local governments are actively taking over responsibility for managing some of these cases, the CDC is reluctant to make them public.”
Mr. Gostin and Mr. Hodge were closely involved in drafting the CDC’s latest quarantine rules in 2017 and opposed allowing the HHS secretary to override the CDC’s medical review. Rules allow the commissioner to take this action, but “it’s just unconstitutional,” Gostin said.
“I was convinced that this was extremely rare and something like this should not have happened. This was not supposed to work this way. There is a clear violation of her constitutional rights,” Gostin added.
Part of his objection is the lack of accountability. “Secretary Kennedy is issuing orders and reviewing his own orders, which is outrageous,” Gostin said. “Political appointees reviewing their orders without providing any evidence or reason. Hodge said officials are required to scientifically justify quarantine orders, “and that’s a constitutional obligation. That’s exactly what Congress expects.”
Robust requirements such as institutional quarantine for hantavirus and bans on travelers from, for example, the Democratic Republic of the Congo, Uganda and South Sudan, are likely to lead to people circumventing the rules or not providing sufficient information about their activities, making it difficult for public health authorities to track potential infections and contain outbreaks at the source, Hodge said.
“The threat is that we don’t know what cases actually exist, because we’ve created a climate where people don’t self-report about this. That’s probably the biggest threat,” Hodge said.

Trump administration officials, including Kennedy and National Institutes of Health Director Jay Bhattacharyya, have criticized the Biden administration and blue states for their response to the new coronavirus, a much more contagious virus, “but their initial response is not public health or science, but coercion,” Gostin said.
