Imran and Bushra’s lawyers given last chance to appeal in £190m case

ISLAMABAD – The Islamabad High Court (IHC) on Tuesday granted a final opportunity to lawyers representing PTI founder Imran Khan and his wife Bushra Bibi to present arguments in their appeals against convictions in the ₹190 million case, warning that no further adjournments will be allowed.

In a written order issued by a division bench comprising Chief Justice Sardar Muhammad Sarfraz Dogar and Justice Muhammad Asif, the court said it would decide the appeals on the basis of the available record after hearing the National Accountability Bureau (NAB) if the appellants’ counsel failed to put forward his arguments in the next hearing.

The bench accepted an adjournment request based on an undertaking from senior advocate Latif Khosa, whose power of attorney on behalf of Imran Khan and Bushra Bibi is already on file. According to the order, Khosa clearly undertook not to seek further adjournment and to present his arguments on the appeals at the next hearing. The court said the matter was adjourned solely on the basis of this undertaking, noting that this was the last opportunity afforded to the appellants.

“The court makes it clear that if the arguments are not advanced in the next hearing, no further adjournment will be granted and the appeals will be decided after hearing the NAB on the basis of the available record,” the order said.

Further, the IHC issued a detailed written order in petitions alleging that Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan (IK) and his wife Bushra Bibi were being held in solitary confinement in Adiala jail, observing that such serious allegations could not be dismissed without first getting a response from the jail authorities.

In a 10-page order, Justice Khadim Hussain Soomro said the allegations of solitary confinement and illegal treatment in prison were serious and could neither be ignored nor dismissed without notice to the respondents and obtaining a factual report from the prison authorities.

The court noted that the trial court sentenced the two convicts to rigorous and simple imprisonment for non-payment of fines, but did not grant solitary confinement as part of the sentence.

The order referred to the National Accountability Bureau’s (NAB) position that the solitary confinement allegations were false.

The court ordered the superintendent of Adiala Prison to submit a full report on whether Imran Khan and Bushra Bibi were being held in solitary confinement and, if so, under what authority and under what legal provisions. The report must also specify the duration of this detention.

Justice Soomro further directed the jail authorities to furnish details of the present conditions of the prisoners, facilities provided to them under the jail rules, and produce the complete jail file and all relevant documents through an authorized officer in the next hearing. The court issued notices to the Adiala Prison Superintendent, the Inspector General of Prisons and the National Accountability Bureau, emphasizing that the question whether the petitions were admissible would be decided only after receipt of the prison superintendent’s report.
