Trump says he will ‘transfer’ Kennedy Center to Congress after legal setback

US President Donald Trump said his administration would transfer control of the Kennedy Center to Congress, after a judge ordered its name removed from the Washington venue and blocked his plan to close it for renovation.

Mr. Trump said on social media that he had directed the U.S. Department of Commerce to “make all necessary arrangements with Congress to enable a full and complete transfer of this institution” and to put lawmakers in charge of its operation, maintenance and management.

It was not immediately clear how Mr. Trump’s directive would be implemented. The Kennedy Center is run by a board of trustees that the president assembled from allies during his second term.

Mr. Trump’s announcement comes after a judge ruled Friday local time that the performing arts center, which Mr. Trump renamed the “Trump Kennedy Center,” could not be renamed without an act of Congress.

U.S. District Judge Christopher Cooper in Washington ordered the Trump administration to remove any physical signage bearing Mr. Trump’s name and eliminate any reference to the “Trump Kennedy Center” from official documents within 14 days.

“The Kennedy Center’s organic statute makes clear that the Center must bear the name of President Kennedy, and it may bear no other official name or public memorial based on the unilateral decision of the Board of Trustees,” Justice Cooper wrote.

“Congress gave the Kennedy Center its name, and only Congress can change it.”

The judge said his decision “does not purport to dictate how the Center should be managed, nor prescribe any particular plan for the institution – construction, closure or otherwise – moving forward.”

The arch inspired by the Arc de Triomphe in Washington DC is meant to commemorate the 250th anniversary of the United States, but its location is causing controversy.

Judge Cooper ruled in a lawsuit filed by Ohio Democratic U.S. Rep. Joyce Beatty, a Kennedy Center board member because of her position in Congress.

Ms. Beatty said in a statement after the ruling that the “Kennedy Center is an institution that belongs to the American people, not Donald Trump.”

Mr. Trump’s plan to renovate the center is part of a broader initiative by the Republican leader to reshape Washington’s monumental core.

He also intends to erect a 250-foot-tall arch and build an 8,360-square-foot ballroom on the site of the White House’s demolished East Wing.

These efforts also face legal challenges. A federal appeals court has allowed the Trump administration to move forward with construction of the ballroom while it reviews the case.

Judge Cooper’s order also ends the Trump administration’s planned two-year shutdown of the Kennedy Center.

The judge said his order does not prevent moving forward with planned repair work, which the trial record “demonstrates is sorely needed.”

The board could still close the center, Judge Cooper wrote, “should it make that decision again after independently and prudently balancing its multiple obligations to the Center.”

Beatty sued the Trump administration in December, calling the building’s renaming a “blatant violation of the rule of law” that “runs counter to our constitutional order.”

His lawyers applauded Judge Cooper’s decision in a statement.

“This is a major blow to the corruption of the Trump administration,” said lawyers Norm Eisen and Nathaniel Zelinsky.

The Kennedy Center opened in 1971 as a living memorial to the late U.S. President John F. Kennedy.
