IHC orders PTI lawyer to file contempt plea for failure to comply with court orders

ISLAMABAD:

The Islamabad High Court (IHC) on Monday expressed displeasure over jail authorities' failure to comply with court orders regarding arranging a meeting between incarcerated PTI founder Imran Khan and his wife Bushra Bibi .

The latter remains incarcerated in the couple's residence, Bani Gala, after it was declared a sub-prison.

Justice Miangul Hasan Aurganzeb, who was presiding over the plea, asked PTI lawyer Usman Gul to file a contempt petition. The judge asked why the court order was not respected.

At the start of the hearing, Justice Aurangzeb said the court had already disposed of the matter with directions. The petitioner's lawyer told the court that he was seeking enforcement of the same order today.

The failure to comply with the court order angered the judge, who then ordered the petitioner's attorney to file a motion for contempt. “We will act, how can court decisions be ignored?

The petitioner's lawyer urged the court to direct the jail authorities to arrange a meeting between Imran and Bushra on the occasion of Eid as the matter fell within their jurisdiction.

The court further ordered the Office of the General Counsel to contact the concerned authorities today and inform them about this matter. He also summoned the Islamabad advocate general.

As the court resumed hearing after a short recess, he asked the attorney general why the court order had not been implemented. The court also ordered the state prosecutor to respond after contacting the chief commissioner's office, Adiala jail authorities and other related entities.

In the last hearing, the IHC allowed a meeting between the incarcerated former prime minister and his wife Bushra Bibi regarding Eidul Fitr.

The court observed that the two should be allowed to meet occasionally and further allowed to meet weekly.

Justice Aurganzeb expressed his displeasure with the prison administration for not allowing the two men to meet and for not transferring the PTI founder's wife to Adiala prison.

The court criticized the authorities' clarifications regarding Bushra Bibi's non-transfer, saying they lacked consistency in light of ongoing admissions.

The judge also chastised the administration for failing to address the court's concerns and observed that it was undermining the rule of law.
