Iddat case: IHC orders court to rule on suspension of Imran, Bushra's sentence in 10 days – Pakistan

The Islamabad High Court (IHC) on Thursday ordered a sessions court to deliver a decision in 10 days on the pleas of PTI founder Imran Khan and his wife Bushra Bibi for suspension of their sentences in the case iddate.

IHC judge Miangul Hassan Aurangzeb also ordered the sessions court to decide their pleas against conviction in the case within a month.

The couple was convicted by a senior civil judge on February 3 for getting married during the Bushra Bibis Iddat period. They were sentenced to seven years in prison and a fine of Rs 500,000 each.

They challenged the conviction before district and sessions judge Shahrukh Arjumand, who recused himself even though the hearing was over and the court was supposed to announce the verdict.

Subsequently, the case was transferred to Additional District and Sessions Judge (ADSJ) Mohammad Afzal Majoka. However, Bushra Bibi's lawyer had filed a petition with the IHC seeking his release on bail and suspension of his sentence.

The Registrar's Office raised administrative objections to the petition because the petitioner sought the same relief in a sessions court.

Hearing his lawyer's arguments on the petition a day ago, Justice Aurangzeb had removed the administrative objections. He also noted that the reason for which Justice Arjumand recused himself was not justified.

The judge today presided over a hearing on Imran's plea to refer ADSJ Majoka's case to Justice Arjumand.

Lawyer Salman Akram Raja, who appeared on behalf of the PTI founder, argued that there were two sessions judges in Islamabad but the case had been transferred to an ADSJ.

He said the case should be referred to Justice Arjumand, who prepared a written verdict, or the IHC itself should hear appeals against the sentence, adding that if this was not possible, the case should be referred to a court judge. not an ADSJ.

A deadline must also be set for sending [the case] at Judge West's sessions, Raja said.

He said, after being asked by the judge why he was demanding delay, that time should be provided to hear the appeal within the stipulated time.

Khawar Maneka's lawyer Raja Rizwan Abbasi said the couple was found guilty by the trial court and an appeal was later heard by a sessions court.

He said his client had expressed no confidence, which was rejected, but Justice Arjumand later recused himself after Maneka again expressed a lack of confidence.

Abbasi said the High Court then took a decision based on the action of Justice Arjumand, adding that a decision regarding the judicial side could not be taken by a single judge.

Justice Aurangzeb said things had been clarified in the judge's order and the IHC chief justice had taken a decision on the matter. What will happen even if this case is dismissed, he asked:

The court ordered Justice Majoka to issue an order within 10 days on the means of reprieve from the sentence of the PTI founder and his wife.
