Azam Khan, Asad Majeed: IK's lawyer raises questions about his statements – Pakistan

ISLAMABAD: Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan's lawyer in the Cypher case has raised questions over the statements of former principal secretary Azam Khan and former Pakistan ambassador in the United States, Asad Majeed.

A special bench comprising Chief Justice Aamer Farooq and Justice Miangul Hassan Aurangzeb on Thursday heard appeals filed by former Prime Minister Imran Khan, his wife Bushra Bibi and former foreign minister Shah Mahmood Qureshi against their convictions in the Cypher and Toshakhana cases.

During the hearing, Khan's lawyer Salman Safdar said that there was a huge difference between Azam Khan's 164 statement and the statement he recorded in court.

Justice Aurangzeb asked what is the difference between the 164 statement and Azam Khan's statement in court. The lawyer replied that Azam Khan said it was a paper that had been waved. The judge then asked me to tell me what the PTI founder had brandished at the rally. The lawyer said that was what the prosecution had to prove.

Lawyer Safdar said Azam Khan said in his statement that he did not know what was in the newspaper that Imran Khan held up at the rally. Justice Farooq observed that no one knows, not even the principal secretary, what was the document that was brandished. If Azam Khan had said in the statement that he had opened the document and read it, then the situation would have been different.

Then the lawyer read Majeed's statement. He said Majeed was Pakistan's ambassador to the United States and had sent the figure. He said the ambassador in his statement said there were no words of conspiracy written in the cipher, but he did not explain the reason why he had to send the cipher.

Justice Aurangzeb said the National Security Committee had recommended that the US ambassador be contacted. He added that making a move means you are offended.

The IHC chief justice remarked that Majeed and Azam Khan could be star witnesses, but there is no such thing in Majeed's testimony.

Lawyer Safdar said that Pakistan's ambassador to the United States is summoned to the National Security Committee meeting. From the United States, he comes to attend the meeting and recommends that the American ambassador be contacted.

Justice Aurangzeb said Majeed was a witness in the case and among the few who saw the figure. Safdar added that he [Majeed] wrote the number in his own hand and sent it to Pakistan. Justice Farooq said Majeed sent what Donald Lu told him. Safdar claimed that Majeed, who sent the code, said he was having dinner with Donald Lu.

Safdar also argued that the trial judge wrote that this crypto episode could harm future relationships. But he said the PTI founder had not violated his oath by taking the people into confidence over the matter.

He argued that the trial judge had written that the encryption episode had caused a lot of damage to relations between the two countries. Justice Aurangzeb asked what the encryption episode means. Justice Farooq said the judge should have written about it more precisely and Majeed also did not specify what he had sent.

Later, the IHC bench postponed the hearing to April 2.
