No need for regulation to supervise online gaming: PM Modi

Prime Minister Narendra Modi has said that no regulations are needed to oversee the online gaming space in India.
He made these comments in a freewheeling chat with top online gamers of the country including Tirth Mehta, Mithilesh Patankar, Animesh Agarwal, Anshu Bisht, Naman Mathur, Ganesh Gangadhar and Payal Dhare.

Responding to a suggestion from Agarwal that the government should recognize esports as a mainstream sport, PM Modi said the space should remain free of regulation for it to thrive.
“It (esports and gaming) does not require any regulation. It must remain free, and only then will it boom, the Prime Minister said.
However, responding to a question from Mathur, who asked whether there was a need to regulate online gaming, Modi felt that the space could be improved by bringing it under an organized and legal structure.
” There are two things. Either you impose restrictions under a law or you try to understand the subject and then codify the space rules into the law of the land according to the industry requirements. This will bring it (the online gaming ecosystem) under an organized and legal structure and strengthen its reputation,” Modi said.
When Agarwal called for separating real money games from skill-based games, PM Modi asked the player to send the suggestions in writing.
Modi's comments come at a time when the online gaming space is reeling from the GST Council's decision to impose a tax levy of 28% on the total face value of online games, without making any distinction between games of skill and chance.
The Council directive was criticized by industry players, who warned of the negative consequences of the new tax regime. Subsequently, online gaming platforms including MPL and Hike cut their workforces, while many others closed their doors as heavy tax liabilities loomed.
Making matters worse are the 71 show cause notices, totaling INR 1.12 Lakh Cr, issued to online gaming companies for the financial year 2022-23 (FY23) and FY24 (till October 2023).
Online gaming startups have claimed to be taxed retrospectively. However, the Center says online betting has always been subject to 28% GST and the tax notices are not retrospective in nature.
