Pakistan's highest court temporarily allows military trials of Imran Khan supporters

ISLAMABAD (Reuters) – Pakistan's Supreme Court on Wednesday provisionally approved military court trials of more than 100 supporters of former Prime Minister Imran Khan accused of attacking military installations.

A six-member panel of the top court overturned an October 23 order issued by a three-member panel of the Supreme Court that declared military trials of civilians unconstitutional, effectively staying all proceedings.

The trial will continue, said Judge Tariq Masood, head of the six-member panel, according to a Reuters reporter in the courtroom.

The six-member panel, however, barred military courts from issuing any convictions pending a final verdict on the constitutional question of whether civilians in such cases fall within the category of fitness for military trial.

The panel will later issue a detailed written order.

The government, which had said it would use military courts to try suspects, raising concerns about the fairness of the judicial process, appealed the October 23 decision.

Hundreds of Khan's supporters stormed military and government installations as well as an air base and also burned down a general's house on May 9, after the former prime minister's brief arrest by paramilitary soldiers . Khan had accused the army of being behind an assassination attempt.

The military denied this and said the attacks on its bases were planned and ordered by Khan's party leaders to stoke political unrest and force early elections after his ouster in a parliamentary no-confidence vote.

Local and international rights groups have expressed concerns about military trials, saying these courts do not have the same standards of proof and due process as civilian courts.

The Pakistan Army Act of 1952 established military courts primarily responsible for trying members of the army or enemies of the state, and they operate under a separate legal system.
