RI appeals to WTO regarding nickel, Jokowi: I'm sure I'll lose again!
Jakarta, CNBC Indonesia – President Joko Widodo (Jokowi) believes Indonesia will lose another appeal against the European Union over its policy of banning exports of raw minerals, including nickel ore, at the World Trade Organization (WTO).
The Indonesian government formally filed an appeal with the WTO Appellate Body in December 2022, after the WTO won the European Union's case over the nickel ore export ban policy of Indonesia since 2020.
President Jokowi acknowledged that many parties oppose Indonesia's policy of banning raw mineral exports. However, he still believes that with this policy, downstream nickel in the country will develop and the downstream nickel industry can become more advanced.
“But it was challenged, sued in the WTO, and sorry, we lost, not won. We lost,” Jokowi said in his opening speech at the 12th Congress of the Indonesian Buddhist Students Association, in the Mercure Convention Center hotel in Ancol. , North Jakarta, Thursday (03/28/2024).
“I’m sure we could lose again, but the industry is ready,” he said.
He believes that although Indonesia will again be declared defeated in this appeal, by then the country's downstream nickel industry will have been developed, like the battery and electric vehicle ecosystem.
“Because building an industry takes time, we don’t know if there will be a second call. If there is another call, don’t back down until the industry finishes building,” Jokowi said.
Jokowi said the export value of Indonesian nickel products jumped several times after the endorsement. He gave an example, the export value of raw nickel was only 2.1 billion US dollars, equivalent to 30 trillion rupiah. However, when it was transformed domestically, the value of Indonesia's nickel industry soared to US$30 billion.
“This represents almost IDR 500,000 billion. Try how many times the value added we get, the taxes we get, the PNBP we get, the export duties we get, the royalties we get for the country,” Jokowi said.
As is known, in November 2022, Indonesia was declared defeated in the case filed by the European Union before the WTO Dispute Settlement Body (DSB) regarding the ban on nickel ore exports since the beginning of 2020.
At least several laws and regulations are considered to violate WTO provisions. First, Law Number 4 of 2009 Concerning Mineral and Coal Mining (UU Minerba).
