TikTok is suing the U.S. government over the new law that would force the short-form video app to split from its China-based parent company, ByteDance, or face a ban in the United States. In a court filing submitted Tuesday, TikTok claims that Congress took the unprecedented step of expressly targeting and banning TikTok and calls the move unconstitutional.

The complaint argues that a sale of ByteDance is not possible and that the law would mandate a shutdown by January 19, 2025.

For the first time in history, Congress has passed legislation that subjects a single, named speech platform to a permanent nationwide ban and prohibits every American from participating in a single online community counting more than of a billion people worldwide, the lawsuit says.

Last month, President Joe Biden signed a law giving ByteDance nine months to divest TikTok or cease operations in the United States, citing national security concerns. However, the complaint alleges that the government has yet to provide evidence of misuse of TikTok by the Chinese government.

Even statements from some members of Congress and a report from a congressional committee simply indicate concerns about the hypothetical possibility that TikTok could be misused in the future, without citing specific evidence, even though the platform is very present in the United States since its launch in 2017. 2017, the lawsuit states.

TikTok argues that a ban in the United States would not be feasible because it would force TikTok to move millions of lines of software code from ByteDance to a new owner.
